{"id":323,"date":"2016-01-29T15:41:10","date_gmt":"2016-01-29T15:41:10","guid":{"rendered":"http:\/\/box5491.temp.domains\/~thewake8\/?p=323"},"modified":"2017-10-05T20:43:08","modified_gmt":"2017-10-05T20:43:08","slug":"asylum-and-the-rights-of-unaccompanied-children","status":"publish","type":"post","link":"https:\/\/www.theweproject.eu\/it\/2016\/01\/29\/asylum-and-the-rights-of-unaccompanied-children\/","title":{"rendered":"Asylum and the rights of unaccompanied children"},"content":{"rendered":"<p>In case of any doubt, the rights of unaccompanied child refugees are clearly defined in the European Union regulations that cover how EU member states should treat asylum seekers<strong>.<\/strong><\/p>\n<p>And contrary to reports in the media (especially the\u00a0<a href=\"http:\/\/www.bbc.co.uk\/news\/uk-35366425\" target=\"_blank\" rel=\"noopener\">BBC<\/a>, which should know better), there is no law that requires refugees to claim asylum in the first safe country they reach.<\/p>\n<p>There are, however, obligations under the\u00a0<strong><a href=\"http:\/\/eur-lex.europa.eu\/LexUriServ\/LexUriServ.do?uri=OJ:L:2013:180:0031:0059:EN:PDF\" target=\"_blank\" rel=\"noopener\">Dublin 3 Regulation<\/a><\/strong>\u00a0for EU member states to take responsibility for asylum seekers who arrive in their country first.<\/p>\n<p>This obligation has been widely ignored during the current and huge refugee crisis.<\/p>\n<p>Some EU states, where refugees have first arrived, have not wanted to help, or felt they couldn&#8217;t help.<\/p>\n<p>No wonder so many wandering, stateless people have had to go from one EU state to another, until they could find one that wanted them and could help them.<\/p>\n<p>It\u2019s one of the main reasons that, last September, Germany\u00a0<a href=\"http:\/\/www.euractiv.com\/sections\/global-europe\/germany-suspends-dublin-agreement-syrian-refugees-317065\" target=\"_blank\" rel=\"noopener\">suspended<\/a>\u00a0the obligations of the Dublin Regulation for Syrian refugees. It was so those refugees could seek asylum in Germany without the other EU countries having to accept responsibility for them, which many weren&#8217;t doing anyway&#8230;.<\/p>\n<p>European Commission President\u00a0<a href=\"http:\/\/europa.eu\/rapid\/press-release_SPEECH-15-5614_en.htm\" target=\"_blank\" rel=\"noopener\">Jean-Claude Juncker<\/a>\u00a0has promised a reform of the Dublin system. \u201cIt is time we prepared a more fundamental change in the way we deal with asylum applications \u2013 and notably the Dublin system that requires that asylum applications be dealt with by the first (EU) country of entry,\u201d he said. And the European Council President\u00a0<a href=\"http:\/\/uk.reuters.com\/article\/uk-europe-migrants-tusk-idUKKCN0UX1TM\" target=\"_blank\" rel=\"noopener\">Donald Tusk<\/a>\u00a0said recently that the EU had \u201cno more than two months to get things under control\u201d or face \u201cgrave consequences\u201d.<\/p>\n<p>As\u00a0<a href=\"http:\/\/www.theguardian.com\/uk-news\/2016\/jan\/20\/fresh-battle-awaits-cameron-as-eu-plans-to-scrap-dublin-regulation\" target=\"_blank\" rel=\"noopener\">widely reported<\/a>, the European Commission is expected to propose scrapping the Dublin Regulation rules that state an EU country where an asylum seeker first arrives has to take responsibility for them. But the\u00a0<a href=\"http:\/\/www.itv.com\/news\/update\/2016-01-20\/uk-very-concerned-over-changes-to-dublin-regulation\/\" target=\"_blank\" rel=\"noopener\">British government\u00a0<\/a>is alarmed by the proposed change. It considers that the Dublin regulation as currently worded works in Britain&#8217;s favour.<\/p>\n<p>After all, the Dublin regulation lets Britain off the hook in having to take responsibility for asylum seekers. Britain is rarely if ever going to be the first EU country where asylum seekers arrive. \u00a0Under the Dublin Regulation, Britain can deport an asylum seeker back to the first EU country they entered. \u00a0Foreign Secretary Philip Hammond is on record saying that any changes to the regulations should &#8220;protect Britain&#8217;s interests&#8221;.<\/p>\n<p>A few days ago an\u00a0<a href=\"http:\/\/www.bbc.co.uk\/news\/uk-35366425\" target=\"_blank\" rel=\"noopener\">Immigration Tribunal<\/a>, in a Judicial Review, over-ruled Britain&#8217;s refusal to allow four Syrian refugees, three of them youngsters, to leave the Calais Jungle and join their relatives in Britain. The British government is likely to appeal against the ground-breaking ruling for fear that it will now\u00a0<a href=\"http:\/\/www.theguardian.com\/uk-news\/2016\/jan\/29\/allowing-four-syrian-refugees-into-uk-may-set-limited-precedent\">set a precedent<\/a>\u00a0.<\/p>\n<p>The Tribunal decided that the four refugees should be allowed to leave the appalling conditions in Calais, where they have been living since October, and immediately come to Britain to be with their relatives here whilst their asylum application is processed.<\/p>\n<p>The ruling clearly demonstrated that the Dublin Agreement isn&#8217;t working.<\/p>\n<p>\u2022 \u00a0<strong>Under the Dublin Agreement \u201cthe best interests of the child should be a primary consideration of Member States\u201d (clause 13).\u00a0<\/strong><\/p>\n<p>\u2022 \u00a0<strong>Under the Dublin Agreement, \u201crespect for family life should be a primary consideration\u201d (clause 14).<\/strong><\/p>\n<p>\u2022\u00a0<strong>Under the Dublin Agreement members of one family should not be separated (clause 15).<\/strong><\/p>\n<p>\u2022 \u00a0<strong>Under the Dublin Regulation, \u201cWhen the applicant is an unaccompanied minor, the presence of a family member or relative on the territory of another Member State who can take care of him or her should also become a binding responsibility criterion\u201d (Clause 16)<\/strong><\/p>\n<p>If the Dublin Regulation was working, there shouldn&#8217;t be\u00a0<em>any<\/em>\u00a0unaccompanied, stateless,\u00a0<a href=\"http:\/\/www.theguardian.com\/uk-news\/2016\/jan\/09\/calais-jungle-child-refugees-uk-asylum\" target=\"_blank\" rel=\"noopener\">traumatised children<\/a>\u00a0living rough for months or more in the abysmal camp known as \u2018the Jungle\u2019 in Calais, France &#8211; one of the world\u2019s richest countries.<\/p>\n<p>If the Dublin Regulation was working, there shouldn&#8217;t be\u00a0<em>any<\/em>\u00a0parentless, vulnerable,<a href=\"http:\/\/www.independent.co.uk\/news\/uk\/home-news\/refugee-crisis-campaigners-court-victory-to-allow-thousands-of-asylum-seekers-to-come-to-britain-a6823781.html\" target=\"_blank\" rel=\"noopener\">refugee children<\/a>\u00a0eking a meagre existence in Calais, when they have relatives in Britain who could look after them.<\/p>\n<p>And if the Dublin Regulation was being taken seriously, why is Britain now planning\u00a0<a href=\"http:\/\/www.mirror.co.uk\/news\/uk-news\/landmark-judgement-rules-calais-crisis-7215425\" target=\"_blank\" rel=\"noopener\">to appeal<\/a>\u00a0against the Tribunal ruling to allow those four war-ravaged Syrian refugees to leave their nightmare endurance in Calais and come to Britain to join their relatives?<\/p>\n<p>So that those poor youngsters, and\u00a0<a href=\"http:\/\/www.unhcr.org.uk\/news-and-views\/uk-press-releases\/unhcr-london-press-releases\/out-in-the-cold-migrants-and-asylum-seekers-find-life-increasingly-hard-in-calais.html\" target=\"_blank\" rel=\"noopener\">others like them<\/a>, will have to continue their cold, homeless, unloved existence in Calais, far away from home, and yet within reach of relatives who could care for them in Britain?<\/p>\n<p>Shame on Britain.
